新知分享:中東地緣政治風險因應策略研討會心得

  日前參與了由台北市海運承攬運送商業同業公會主辦的研討會 。在當前國際局勢瞬息萬變的背景下,這場講座從「風險保險」與「航商實務」兩大核心維度切入 ,為全球供應鏈面臨的嚴峻考驗提供了許多啟發。

  研討會開場時,公會播放了一段影片。影片大意講述了目前美國與伊朗之間的戰爭反覆膠著,進而導致中東附近海域相當不平靜的現狀,揭示了地緣政治對實體經濟的衝擊。基本上,中東局勢的動盪除了直接引發國際油價波動的問題之外,最受其害的就是貨物運輸。航線被迫調整與船期延誤已成新常態。現代海運物流早已無法與國際政治脫鉤,企業的抗風險韌性正迎來前所未有的挑戰。

 

保險!但不能全靠保險:釐清戰爭險的防線與盲點

  在第一場關於海上保險實務的講座中,國泰世紀產物保險的陳協理深入剖析了區域衝突下的保險規劃 ,其中關於「戰爭險」的探討讓筆者收穫最為豐厚。講師清晰地界定了戰爭險在船體與貨物兩個不同層面的法律適用。船體部分主要採用英國倫敦保險人協會的「協會時間條款 ITC-1983」,而貨物則是以「協會貨物條款 ICC(A)-1982」為基底,兩者在實務上都可以根據需求,再額外加保戰爭、罷工、暴動險來轉嫁風險。然而,講師也特別提醒,戰爭險並非萬能,其中存在著嚴格的除外責任。例如核子武器攻擊、聯合國安理會五大常任理事國之間爆發的戰爭、戰時徵用與扣押等極端狀況,保險公司皆不予理賠,且一般的貨物險也不承保營業損失。在約定額外保險條件時,必須特別注意「兵區除外地區」的規定。這是由聯合戰爭委員會動態公告的高風險海域,當船舶欲駛入這些指定區域時,貨主或航商必須提前通知保險人並加繳額外的保費,否則保險契約將面臨暫停或失效的風險,是操作實務上不可忽視的盲點。

 

跨國航商應變實務:由CMA CGM主講

  第二場講座由 CMA CGM 達飛通運的林董事長與潘總經理等人主講。雖然內容帶有較強力的跨國航商優勢色彩,但從第一線戰區運送實務的角度來看,卻是非常具建設性的市場提醒。達飛提到其在動盪的紅海航線中,因其集團的地緣背景,加上能獲得法國海軍艦隊的實質護航與武裝護衛,使其在危機中具備更強的安全保障。這帶給業界一個很重要的反思,當未來企業有貨物必須強行通過戰區時,除了比拼運價與船期之外,航商背後的政治資源、軍事護航背景與整體的安全防禦實力,都應該納入篩選供應商的關鍵指標中。

  此外,幾位也分享了航商在企業社會責任上的多元面向。他們特別提到達飛曾協助將民間或政府的緊急消防車輛等救災物資運送至烏克蘭前線。這也讓大家反思,現代航運物流巨頭的企業社會責任已經不局限於節能減碳等常見的環保 ESG 面向,當國際衝突爆發時,如何運用自身的跨國運力優勢進行人道救援,更是彰顯企業社會價值與地緣影響力的重要一環。

 

結語:如何在暴風雨中穩步前行?

  整體而言,這場研討會對大家都有各種啟發。面對動盪的國際大局,海運承攬業與進出口企業不能再只當被動的受害者。透過這兩場講座的串聯,筆者認為,現代物流管理必須從傳統的「成本與效率導向」提升為「風險與韌性導向」。

  舉例來說,在事前,企業必須透過精準的保險條款控管風險,理解戰爭險的除外限制以避免保障真空。而在事中,則需要彈性選擇具備強大政經背景與安全保障實力的航商。行有餘力時,亦要關注企業在非常時期的社會責任作為。

  唯有將國際政治局勢、法律保險規範與航商防禦實力納入一體的通盤考量,我們才能在不平靜的全球海域中保全資產,在多變的未來新常態中安然度過變局。

海運科普:為什麼鋰電池火災這麼難搞?從MSC近期案...

  想像一下,你把一輛 2018 年的特斯拉 Model S,和一輛 2012 年的福特 Focus,像疊樂高一樣用木頭架子疊在一個 40 呎高櫃裡。接著,這個貨櫃被送上一艘巨大的遠洋貨輪,準備從陽光明媚的加州出發,經歷數週的海浪顛簸,前往遙遠的立陶宛。

  你覺得這個木架子,能撐過大西洋的洗禮嗎?

  2023 年 9 月 2 日凌晨,全球最大海運航商地中海航運(MSC)旗下的 MSC Carlotta 號貨輪,在航行至墨西哥下加利福尼亞外海時,用一聲巨響和熊熊烈火回答了這個問題。

  而在近期,這場海上驚魂演變成了一場高達 27.3 萬美元(約合新台幣 850 萬元)的法庭索賠大戰——MSC 已對負責裝櫃的美國車輛物流商 CargoLoop 提起訴訟。

 

火災現場證據說話:從木架倒塌到鋰電池熱失控?

  為什麼木架塌陷,會演變成讓全船大驚失色的爆炸火災?這就要從最常見的鋰電池火災原因:熱失控(Thermal Runaway)說起。根據火災鑑識人員的現場還原,這起事故最可能的劇本是:物理結構的失效,引發了連鎖的化學災難。

【熱失控連鎖反應與起因】

  木架因震動或載重而塌陷 ➔ 特斯拉壓毀下方車輛 ➔ 電池芯遭物理擠壓/破裂 ➔ 內部短路瞬間產生高溫 ➔ 電解液分解釋放可燃氣體 ➔ 壓力過大爆炸起火

  1. 第一步:物理結構崩塌導致電池受壓力毀損
      海上航行時,船舶會隨浪湧產生高頻率的震動與傾斜。當貨主用非專業的木質支架在密閉空間進行垂直雙層疊壓時,木架在長期受力與晃動下斷裂,上方沉重的特斯拉直接因此崩塌,重壓在下方的福特車上。
  2. 第二步:鋰電池內部短路與連鎖化學反應
      巨大的衝擊力導致電動車底盤的鋰電池芯遭到擠壓破裂、內部隔膜損壞,瞬間引發內部短路。而短路產生的焦耳熱讓電池內部溫度在幾秒鐘內飆升。
  3. 第三步:熱失控爆發起火燃燒
      當鋰電池內部溫度超過臨界點(通常在 130°C 至 150°C 之間),正負極材料與電解液會開始劇烈分解,釋放出大量的一氧化碳、氫氣及揮發性有機氣體。在密閉、高溫且充滿可燃氣體的貨櫃內,最終引發了貨櫃爆炸,並迅速蔓延至鄰近貨櫃。

  此外,MSC 推測,該物流商可能並未落實最基本的安全防護:將車輛的電池進行安全斷電。這無異於讓這顆不定時炸彈一直處於隨時可以引爆的待機狀態。

 

海運界集體頭痛中:為什麼鋰電池火災這麼難搞?

  對現代貨櫃船來說,鋰電池火災絕對是船員的噩夢。

  鋰電池火災就像是一場無法完全根絕的火災,常規火災可以透過切斷氧氣(如噴灑二氧化碳或泡沫)來撲滅。但鋰電池熱失控在化學分解過程中,其自身的材料就會釋放氧氣(主要來自正極材料的高溫分解),也就是即使在沒有外部空氣的密閉貨櫃裡,它自己也能繼續悶燒並持續提供燃燒動力。

  而若要撲滅鋰離子電池火災,根據各類火災宣導內容,目前最有效的方法是用大量且不斷的水源澆水降溫,直至內部的化學反應徹底終結。但海事專家指出,撲滅電動車火災所需的水量,是一般燃油車的數倍甚至十倍以上。在船上瘋狂灌水,不僅可能損壞其他完好的貨物,還可能因為自由液面效應影響船舶重心,導致整艘船傾覆。更糟的是,如果降溫不徹底,過幾天它還可能再度復燃。

 

27 萬美元的教訓:誠實申報只是基本,專業加固才是重點

  在這起案件中,貨主雖然老實申報並坦言是「二手且有受損的電動車」,但如果放到現在,他們的申報難度將大幅提升。因為自 2026 年 1 月 1 日起,IMDG Code 最新實施的第 42-24 號修訂版,已經全面加嚴了鋰電池車輛的運輸規定。過去所有電動車不分種類,都能統一用含糊的「UN 3171(電池驅動車輛)」進行申報,但新規要求,鋰離子電池驅動的車輛必須改用專屬的「UN 3556」,鋰金屬電池車輛為「UN 3557」、鈉離子電池車輛則為「UN 3558」。此外,安全資料表(SDS)第 14 節等海運文件若仍引用舊版 41-22 修訂版,將被視為無效文件,貨物可能因此遭拒絕裝船。然而,誠實申報也只不過是拿到了海運的門票,裝櫃時的物理加固與技術細節,才是真正決定航行安全的關鍵。

  這場官司給整個全球物流業敲響了警鐘:過去發生貨櫃火災,大家習慣分攤共同海損。但現在,船公司開始精準狙擊,只要證實是貨主裝櫃不當、使用劣質加固或未落實安全斷電,船公司就會直接依據合約與侵權行為,將火災調查費、其餘貨主理賠金及船舶損失,全額跨海追償。在這個新能源產品出口持續擴增的時代,許多船公司也已經開始調整新能源車輛的有關政策,例如停收二手電動車、或提高相關條件等,對相關貨物實施更嚴格的標準。而針對貨運代理業者,則更需注意車輛是否受損、貨櫃內加固是否有確實做好以及相關申報是否皆有合規等。

  畢竟,在動輒載運上萬個貨櫃的現代巨輪上,任何一個貪圖方便的心態,都可能在公海上演變成一場吞噬數百萬美元的災難。

A) 承運人在裝貨港的辦事處或代理人將根據托運人申報或視為已申報的貨物描述、實際使用的貨櫃數量等資訊評估貨物的運費和附加費。該評估須遵守承運人提單的條款和條件。儘管有上述規定,承運人仍可自行決定在裝貨港或目的港安排核實托運人申報的所有此類貨物的資訊;所獲得的資訊將用於確定應支付的正確運費和附加費金額。所有產生的費用均由貨物承擔。
B) 為確保托運人申報資訊的準確性,並確保嚴格遵守承運人運價表和任何服務合約的規定,承運人可要求提供必要的單據以核實合規性,包括但不限於發票、海關單據、提單所依據的運費單據和到貨通知。上述要求應在裝運日期後一年內提出。托運人或收貨人應在收到要求後三十 (30) 天內提供所需單據。如要求在貨物交付給收貨人之前提出,承運人不得放行貨物,直至收到所需單據。
C) 若因上述 A) 和 B) 項的原因發現有申報錯誤或描述錯誤,則貨物相關方應承擔下列責任:
(1) 以正確費率計算的該貨物應支付的額外適用關稅或合約運費及費用,該費用應由任何負有支付運費及費用責任的一方支付;
以及
(2) 每貨櫃 500.00 美元的額外費用,該費用應由造成描述錯誤或申報錯誤的一方支付。此項費用應針對每批貨物的每處描述錯誤或申報錯誤分別收取。例如,如果托運人對貨物描述錯誤,並且在同一批貨物中也錯誤申報了貨物的重量或尺寸,則該批貨物將收取兩次費用。

全球範圍內,申報不實貨物的行政罰款基本為每份提單5000美元。中國除外,在中國,同樣的罰款是每貨櫃15,000美元。

另請注意,發貨人和收貨人將承擔因申報不實而產生的一切相關費用和後果的全部責任。這包括糾正措施、索賠、罰款、債務、損失、延誤、損害賠償或任何其他營運費用,這些費用將另行計費。

  危險品申報
危險貨物必須完全依照《國際海運危險貨物規則》(IMDG規則)申報(包括聯合國編號、類別、正確運送名稱、數量和包裝)。將危險貨物誤報為非危險貨物或提供任何不完整/虛假的危險貨物資訊都會造成安全風險,並可能在任何時候引發操作拒收、糾正措施和額外費用,即使在訂艙已被接受和/或以星航運已在裝貨港接收集裝箱之後也是如此。
貨物描述及海關編碼
出貨說明(SI)必須包含準確詳細的商品描述,並與有效的6位或10位HS編碼(如適用)相符。資料缺失或不一致可能導致出貨說明被拒收,進而造成出貨延誤、查驗、延期或海關清關延誤。
申報不完整/不實的後果

為確保船員、船舶及船上客戶貨物的安全,請注意,自2020年11月15日起,赫伯羅特將對
故意未申報或錯誤申報危險貨物的行為,在全球範圍內對每個集裝箱收取15,000.00美元的罰款。
此外,赫伯羅特將追究托運人因未申報或錯誤申報危險貨物而導致的所有違規行為、罰款、損害賠償、
事故、索賠及糾正措施所產生的一切費用和後果。該罰款僅適用於故意未申報或錯誤申報危險貨物的情況。
 本協議中列明的所有其他費用,違約金金額為以下兩者中的較高者:
a) 適用的貨物NOS費率,依申報的重量、尺寸或
件數計算;或
b) 2,000.00美元,此外還需支付託運人申報但未經承運人核實的所有其他費用。

3. 違約金
托運人應向承運人或其代理人支付任何
額外的運費和費用。托運人也應支付違約金,如下:
a. 若應付的額外運費低於正確運費和費用的百分之二 (2%),
則不評估違約金。
b. 若應付的額外運費佔正確運費和費用的百分之二 (2%) 或以上,
則將收取相當於應付額外運費三 (3) 倍的違約金。

4. 附加費用
除任何其他應付的額外運費和費用以及
違約金外,托運人還需支付以下費用:
a. 如果因無需在承運人貨櫃貨運站 (CFS) 卸貨的檢驗而導致應付額外運費,
則將向托運人收取 60 美元的費用。
b. 若因需要全部或部分卸貨和
重新裝載貨櫃的檢驗而導致應付額外運費,
則托運人將承擔此類檢驗的費用。
為計算此類費用,
承運人將以實際處理的貨物數量,對普通貨物收取 27 美元,對冷藏貨物收取 35 美元。
一般貨物的最低檢驗費用為 270 美元,冷藏貨物的最低檢驗費用為 350 美元。

OOLL-100 S-6 貨物申報不實

A. 托運人保證其或其代理人向承運人提供的所有可能影響適用運費或其他費用的文件和其他資訊均準確無誤。承運人可酌情指定一名經宣誓的計量員打開由托運人或其代理人包裝的任何集裝箱,以核實托運人申報的貨物描述、貨物性質、貨物重量、貨物尺寸和/或件數,以及托運人是否遵守承運人的運價規則和費率。對於因上述核實而導致的任何貨物損失或損壞,或貨物運輸或交付延誤,無論托運人是否正確陳述了上述信息,承運人人均不承擔任何責任。貨櫃將重新加蓋承運人印章,並在提單上註明或以其他方式通知托運人有關此檢查的資訊。

E. 承運人透過實體貨物檢驗發現貨物描述不實,或透過其他證明文件或託運人在貨物處於承運人保管期間更改申報,則應:
     i. 從普通貨物 (GC) 到危險貨物 (DG),無論是乾式裝載或冷藏裝載,或
     ii. 危險貨物描述的變更,例如但不限於類別變更;聯合國編號變更;包裝類別變更;技術名稱變更或濃度百分比變更,或
     三、禁運/限制貨物,或
     四、易燃貨物、鋰電池、木炭、魚粉、籽餅、肉骨粉,或
     五、地方當局確認有貨物走私及貨物申報不實的情況。
托運人應在貨物放行前支付以下額外款項:
1. 實際貨物描述與原申報描述之間的運費和費用差異。
2. 除上文第(iv)項所述的危險貨物外,所有貨物描述錯誤的情況均應按每集裝箱30,000美元的標準支付違約金。對於上文第(iv)項所述的危險貨物,應按每集裝箱50,000美元的標準支付違約金。
3. 如進行實體檢驗,則托運人需承擔所有與實物檢驗相關的費用,外加每貨櫃75美元的管理費。此外,托運人還應賠償承運人因貨物描述不實而遭受的一切損失、損害、費用、訴訟和索賠,並使其免受損害。
托運人(同一國家的任何分支機構)在同一日曆年內多次在同一原產國錯誤申報危險貨物,和/或交付的任何錯誤申報的危險貨物造成包括但不限於火災/爆炸/洩漏/溢出等事故,和/或貨主因錯誤申報貨物而被主管機關認定有刑事罪行,則承運人將暫停其向承運人預訂其危險期限至少為任何危險期限。在解除暫停之前,托運人必須向承運人提交一份危險貨物錯誤申報預防計畫以供審核。如果承運人認為托運人提交的預防計劃不足以滿足其要求,則承運人保留拒絕該計劃的權利。
 F. 如果發現貨物在熏蒸過程中沒有進行適當的通風,並且集裝箱上缺少按照國際海事組織要求粘貼的警告標誌,則將對每個集裝箱處以 200 美元的虛假申報費。

002-D03 / MISDECLARATION OF CARGO
Rule: 002-D03 Misdeclaration Of Cargo
This provision applies to all cargoes other than dangerous goods and hazardous cargoes
which are covered separately in Rule 016. To ensure the accuracy of the description and
measurements declared by the Merchant, and to ensure that the provisions of this tariff
and any service contracts are strictly adhered to, a Carrier may request documentation
necessary to verify compliance, including but not limited to invoices, customs documentation,
freight bills underlying Bills of Lading, and arrival notices. Said requests shall be made
within one year after the shipment date. Merchant shall provide documentation requested
within thirty (30)days of the request.
If the request is made prior to the release of cargo to the Merchant, the Carrier shall not
release the cargo until the documentation is provided.
If a misdescription or misdeclaration is found as a result of this inquiry, the Merchant
shall be liable to pay.
(a) the additional applicable tariff or contract freight and charges due on such cargo as
rated correctly, which shall be payable by any party liable for payment of the
freight and charges; and
(b) except as provided in (c) –(d) infra, and Tariff Rule 002-C15 regarding Verified Gross
Mass under SOLAS, an additional amount equal to three times the total of all tariff, or
contract, freight and charges due on the cargo as rated correctly, which shall be paid
by the party responsible for the mis-description or mis-declaration. This re-rating
charge as set forth in this subparagraph (b) shall be applied separately for each
mis-description or mis-declaration on a shipment. For example, if the Merchant
mis-describes the commodity and also mis-declares the weight or measure of the cargo on
the same shipment, the re-rating charge would apply twice for that shipment.
(c) Where the Merchant has mis-declared or mis-described waste commodities, recyclable
cargoes, second hand and usedcargoes, a Waste Cargo Misdescription Fee (MMC) will be
charged as follows:
(i) USD 10,500 per container where the Merchant voluntarily makes a request to correct
the cargo description before Carrier ascertains that the cargo has been misdescribed.
(ii) USD 21,000 per container where the mis-declaration/mis-declaration is discovered by
Carrier after the cargo has been received for shipment by the Carrier and no prior
request has been made by the Merchant to correct the description before discovery by
the Carrier.
(d). Where Merchant has mis-declared or mis-described non-hazardous cargo with special
declaration requirements a Special Cargo Misdeclaration Fee (MMC) will be charged as
follows:
(i) USD 5,500 per container where the Merchant voluntarily makes a request to correct
the cargo description before Carrier ascertains that the cargo has been misdescribed.
(ii) USD 11,000 per container where the mis-declaration/mis-declaration is discovered by
Carrier after the cargo has been received for shipment by the Carrier and no prior
request has been made by the Merchant to correct the description before discovery by
the Carrier.
The foregoing charges are without prejudice to Carrier’s rights under subparagraphs (e)-(g) infra.
(e) If documentation is not provided within the thirty (30) days as requested, the Carrier
may conclude that a misdescription or misdeclaration has occurred and apply the above
additional charges.
(f) If a shipment is found to be misdeclared prior to release, the cargo shall not be
released to the Merchant until the applicable tariff or contract freight and cargoes
referred to in (a) and (b)above, along with any demurrage charges that might be due,
have been paid in full.
(g) Marchant shall also be unconditionally liable to indemnify, defend, and hold Carrier
harmless against all claims, costs and liabilities of whatever nature arising out of any
misdeclaration of, or non compliance with, government regulation in regard to declaring
or misdeclaring the nature and content of the cargo. This shall include, but not be
limited to:
(i) Any fine, penalty, storage, demurrage or detention charge (of whatever nature) or
any costs of on forwarding, return, disposal, destruction or salvage of any cargo
shipments which arise out of the transportation, discharge and/or delivery of such
shipments.
(ii) Any costs and fees incurred in connection with administrative or legal proceedings
being commenced against Carrier in connection with the transportation, discharge,
storage and/or delivery of the cargo.
(iii) All claims, suits or proceeding of whatever nature instituted against Carrier by
third parties for claims arising as a result of the misdescription and/or
misdeclaration of the cargo.
(iv) All claims by Carrier for loss or damage to the carrying vessel, loss or damage to
containers and cargo carried aboard the carrying vessel , General Average and salvage
expenses incurred by the Carrier and loss of Carrier’s bunkers.

HDMU-040-139 A. The shipper guarantees any and all documents and information provided
to the Carrier are complete and accurate with regards to the applicable
freight including, but not limited to, commodity description, weight, piece
count, and its general or hazardous nature. Carrier may open any
container packed by or on behalf of the shipper to verify its contents at
its own discretion. Carrier shall have no liability and will not be
responsible for loss or damage to goods or the delay in delivery
resulting from verification.

The shipper shall be responsible for any freight and charges due if, upon
inspection by the Carrier or local Customs, it is found to have provided
an incorrect or incomplete description of commodity, weight, measure,
or piece count.

In the event a misdeclaration or misdescription is confirmed by means of a cargo inspection by the carrier, local customs or by other supporting documents, penalty fee will be assessed by the carrier as below.
It will include all of the transport mode including but not limited to mother vessel, feeder, barge, truck, rails.

B. In regards to each nation’s government sanction, if misdeclaration or false declaration is found in shipping documentation,

Additional costs means the costs charged to the Carrier as an extra by subordinate service providers, terminals, railways, and etc., other than the costs necessary to complete transactions.

ONEY-101-2.075 Compensation for Breach of Agreement (CBA)

A Compensation for Breach of Agreement (CBA) charge will be applied and payable to the Carrier for all hazardous and non-hazardous cargo with special declaration requirements that are misstated. This includes, but is not limited to, cargo with special loading requirements, non-hazardous chemicals, and batteries. Additionally, a CBA charge will be applicable for all misstated prohibited articles. This charge is separate from and in addition to any potential extra costs, fines, or penalties incurred from vendors or state/federal/government entities. The specific details of this charge are outlined below.

1)
a. Voluntary amendment request made by the customer before or after the arrival at the destination due to concealing, omitting, or misdeclaring any particulars in the description of goods at the booking stage.

Quantum:
USD 15000 per container for hazardous cargo or hazardous prohibited articles

b. Voluntary amendment request made by the customer after the time of manifest creation due to concealing, omitting, or misdeclaring any particulars in the description of goods at the booking stage.

Quantum:
USD 3000 per container for non-hazardous cargo with special declaration requirements and/or special stowage requirements or non-hazardous prohibited articles

2)
Amendment forced by the Carrier who found a misalignment between the declared information during the usual checking stage for concealment, omission, or misdeclaration of any particulars in the description of goods.

Quantum:
USD 6000 per container for non-hazardous cargo with special declaration requirements and/or special stowage requirements or non-hazardous prohibited articles
USD 30000 per container for hazardous cargo or hazardous prohibited articles

Notes:
-The Carrier has the right to withhold the goods and refuse any change(s) until the Customer pays the Compensation for Breach of Agreement (CBA) charge.
-The Customer shall be responsible for any potential  extra costs as well as fines or penalties incurred from our vendors or state/federal/government entities.
-The Compensation for Breach of Agreement (CBA) charge, if any, will be in addition to any potential extra costs as well as fines or penalties incurred from our vendors or state/federal/government entities.
-For any changes resulting in the cargo from being declared non-hazardous cargo to hazardous cargo, either at the carrier premise, during transit, or at destination; the higher Compensation for Breach of Agreement (CBA) quantum will always be charged.

MISDESCRIPTION/MISDECLARATION OF CARGO
A)  The offices or agents of the carrier at the base loading
    port will assess freight and surcharges on the shipments
    on the basis of the information such as cargo description,
    actual utilised container declared or deemed to have been
    declared by shipper.
    Such assessment is subject to the terms and conditions
    of the carrier's Bill of Lading.
    Notwithstanding the foregoing, carrier may arrange at the
    port of loading or destination for the verification of the
    information declared by shipper of all such shipments, at
    its discretion; and the information so obtained shall be
    used for determining the correct amount of freight and
    surcharges which have to be paid.  All expenses incurred
    shall be for the account of the cargo.

B)  To ensure the accuracy of the information declared by the
    shipper, and to ensure that the provisions of carrier's
    tariff(s) and any service contracts are strictly adhered
    to, carrier may request documentation necessary to verify
    compliance, including but not limited to invoices, customs
    documentation, freight bills underlying Bills of Lading,
    and arrival notices.  Said requests shall be made within
    one year after the shipment date.  Shipper or consignee
    shall provide documentation requested within thirty (30)
    days of the request.  If the request is made prior to the
    release of cargo to the consignee, the carrier shall not
    release the cargo until the documentation is provided.

C)  If a misdeclaration or misdescription is found as a
    result of A) and B) above, the cargo interests shall be
    liable to pay:
    (1)  The additional applicable tariff or contract
         freight and charges due on such cargo as rated
         correctly, which shall be payable by any party
         liable for payment of the freight and charges,
    And

    (2)  An additional amount equal to USD500.00/container,
         which shall be paid by the party responsible for
         misdescription or misdeclaration.  This charge shall
         be applied separately for each misdescription or
         misdeclaration on a shipment.  For example, if the
         shipper misdescribes the commodity and also
         misdeclares the weight or measure of the cargo on
         the same shipment, the charge would
         apply twice for that shipment.

D)  If documentation is not provided within the thirty (30)
    days as requested, the carrier may conclude that a
    misdescription or misdeclaration has occurred and shall
    apply the above stated additional charges.  If a
    shipment is found to be misdeclared prior to release,
    the cargo shall not be released to the consignee
    until the applicable tariff or contract freight and
    charges referred to in paragraph C(1) above have
    been paid in full.

WAN HAI Yes Generally, USD 100,000 per container   From now on, if the declarations and shipping forms and documents enclosed are not true and not accurate, WHL has the rights to immediately stop or suspend the delivery of the cargoes or terminate the contract of delivery for the cargoes at any time during the carriage. Your esteemed company (also including the shipper, the notifying party and the consignee) shall assume and bear any expenses and fees incurred and all liabilities of damages and losses, costs, including but not limited to, fines, forfeits, penalties, attorney fees, litigation costs, and, in addition, shall pay punitive damages as follows:

 

If the cargoes involved in violation of the relevant requirements are Hazardous Cargoes, the punitive damages shall be USD100,000 per container.

If the cargoes involved in violation of the relevant requirements are Non-hazardous cargoes, the punitive damages shall be USD100,000 per container.

 

New deposit collection: USD 100,000 (full liquidated damages and deposit will be collected within one week after concealment is discovered.), the deposit will be used as subsequent and relevant overdue fees such as container damage, detention fee (overdue fees involving underreporting need to be calculated at 3 times), terminal fees, local customs related processing fees, etc.
All risks, responsibilities and/or any damages, losses, claims, fines and any consequences arising out or in connection with the safety accidents if occurred and resulted from concealment of shipments will be charged accordingly. If there is any shortfall, it must be made up.

TS LINES Yes Generally, USD 100,000 per container   To reinforce the management of transport safety, TS Lines will further strengthen the inspection
and supervision of all cargo declarations (including but not limited to dangerous goods). Any
failure to accurately declare cargo in accordance with regulations—including but not limited to the
following scenarios—will result in severe penalties. In addition to pursuing compensation for all losses
and costs incurred, our company will impose fines on customers who violate cargo declaration
requirements:
1. Failure to fully and correctly declare cargo that is, in fact, classified as dangerous goods.
2. Concealment of dangerous goods by declaring them as non-dangerous goods.
3. Misdeclaration, omission, or concealment of the hazard class or UN number of dangerous
goods.
4. Any other form of misdeclaration, omission, or false declaration of cargo information.
For any cargo found to be involved in misdeclaration, concealment, or omission,
a fine of USD 100,000 per container will be immediately payable upon
notification. Any additional costs incurred—such as container damage, demurrage,
terminal charges, customs handling fees, or government-imposed penalties—shall
be borne and paid in full by the customer, as notified by our company.

  Every cargo not correctly declared can endanger the safety of our crews, our assets, the environment, and other customers’ cargo.
As we continue detecting several misdeclarations recently, Maersk would like to emphasize that all customers who misdeclare their dangerous cargo will be charged with a Misdeclaration fee.

What is a misdeclaration?
A misdeclaration is an incorrect, incomplete, or false declaration of cargo, any classified dangerous goods not documented with dangerous goods declaration as per the IMDG code.

The administrative fee for misdeclared cargo globally is 5,000 USD per bill of lading as a base level. Exception China, where the same fee is USD 15,000/container.

Please also note, that both the shipper and consignee will bear full responsibility for all associated costs and consequences resulting from misdeclaration. This encompasses corrective measures, claims, fines, liabilities, losses, delays, damages, or any further operational expenses, which will be billed separately.

i. Non-DG cargo mis-declared as DG cargo or requested to be amended to NonDG cargo after release of empty container.
ii. Cargo description / HS code / weight / dimension / VGM / quantity and any other
information declared to carrier is incomplete, insufficient or different from that of
actual stuffed cargo (except for VGM discrepancy within tolerance granted by
applicable law).
iii. Non-DG cargo found as counterfeit cargo, military cargo or any other cargo that
is not allowed for export from China or carriage of which will expose carrier to
liability.
The fee shall be paid in addition to any expenses/ costs/ losses/ damage incurred to our
vessels/ crews/ staffs/ properties and the terminal/ port staffs/ properties arising out of or in
connection with the cargo misdeclaration.

MSC Yes Generally, USD 3,500 per container   MSC would like to inform you that we will increase the amount of our export Misdeclaration Fee (CMD) as from 1 April 2022 to USD 3500/container on all cargo from Cambodia, China, Hong Kong, Indonesia, Japan, Korea, Malaysia, Myanmar, Philippines, Singapore, Taiwan, Thailand and Vietnam to all destinations.

The fee is applicable in the following circumstances:

Any change of named account, after the booking has been confirmed by MSC and in the event the rate level is lower than what was initially booked.

  Dangerous Goods (DG) Declaration
DG cargo must be declared in full compliance with the IMDG Code (including UN number, class, proper shipping name, quantities, and packaging). Mis-declaring DG as non DG or any incomplete/false DG data creates safety risks and may trigger operational refusals, corrective actions and additional fees at any time even after the booking has been accepted and/or after the container has been received by ZIM at the port of loading.

Cargo Description & HS Codes
Shipping Instructions (SI) must include an accurate and detailed commodity description aligned to a valid 6 or 10-digit HS code (as applicable). Missing or inconsistent data may lead to SI rejection resulting in possible shipment delays, inspections, roll overs, or customs delays.

Consequences of Missing/Incorrect Declarations
Absent or inaccurate declarations may delay, roll, or prevent loading. In addition, administrative misdeclaration fees may be applied per container, as well as other corrective costs assessed by authorities, ports, or terminals.

ZIM may share misdeclaration data with authorities to protect people, assets and the environment or as otherwise legally required.

We hereby would like to update the applicable fees of misdeclarations or missing declarations as follows*, Effective February 16, 2026:

To ensure the safety of our crew, ships and customer cargo onboard,
please note that for purposely undeclared or mis-declared hazardous
cargoes, Hapag-Lloyd will implement a fee of USD 15,000.00 per
container globally, effective as from November 15, 2020.
 
Notwithstanding, Hapag-Lloyd holds the Shipper liable and responsible
for all costs and consequences related to violations, fines, damages,
incidents, claims and corrective measures resulting from cases of
undeclared or misdeclared dangerous cargoes.
 
The fee will only apply and will only be enforced in the envent of
purposely non- or mis-declared dangerous cargoes.
 1.Shippers warranty
Shipper warrants that all documents and other information provided to
the carrier by the shipper or its agents which may affect the
applicable freight or other charges are accurate. Such documents
and/or information include, but are not limited to:
a.Description of goods;
b.Weight, measurement, piece or package count or other form of
freighting provided in the tariff for the cargo;
c.Bills of Lading;
d.Export declaration;
e.Container manifest, packing or shipping list, invoice, or similar
document;
f.Any other document or information required by the tariff or
applicable law.
 
2.Carrier verification
a.Carrier, at its discretion, may arrange for the verification of the
description, weight, measurement, or value of cargo.
b.Carrier may request documentation necessary to verify compliance,
including but not limited to invoices, Customs documentation, freight
bills, underlying bills of lading, and arrival notices.
c.Shipper or consignee shall provide documentation requested within
thirty (30) days of the   request.
d.If the request is made prior to the release of cargo to the
consignee, the Carrier may not release the cargo until the
documentation is provided.
e.If a misdescription or misdeclaration is found as a result of this
inquiry, the cargo interests shall be liable to pay additional
freight as per the terms of this rule.
f.If a shipment is found to be misdeclared prior to release, the
cargo may not be released to the consignee until the applicable tariff
or contract freight and charges referred to in this rule, along with
any demurrage charges that might be due, have been paid in full.
g.Container inspection for purposes of verification may take place at
origin or destination, and at consignees premises if needed.
h.If the inspection is performed at Consignee's premises and the
consignee interferes, obstructs, or refuses to permit such inspection,
the Shipper shall be required to pay liquidated damages in lieu of
all other charges named herein, based on the greater of:
a)The applicable cargo NOS rate, at the declared weight, measure or
piece count,    or
b)$2,000.00, in addition to all other charges declared by the shipper,
but not verified by the Carrier.
 
3.Liquidated damages
Shipper shall be required to pay to Carrier or its agent any
additional freight and charges. The   Shipper will also pay liquidated
damages as follows:
a.If the additional freight due is less than two (2) percent of the
correct freight and charges, then no liquidated damages will be
assessed.
b.If the additional freight due is two (2) percent or more of the
correct freight and charges, then liquidated damages of three (3)
times the additional freight due will be assessed.
 
4.Additional charges
In addition to any other additional freight and charges due and
liquidated damages, the shipper will also pay the following:
a.Where discrepancies resulting in additional freight due arise from
an inspection which does not require the container to be unloaded at
carriers CFS, charge of $60 will be assessed against the Shipper.
b.Where discrepancies resulting in additional freight due arise from
an inspection which requires complete or partial unloading and
reloading of a container, the shipper will be responsible for the
costs of such inspection. For the purposes of calculating such costs,
the carrier will charge $27 W for ordinary cargo, and $35 W for
refrigerated cargo on  the cargo actual handled.  The minimum charge
for inspection shall be $270 for ordinary cargo, and $350 for
refrigerated cargo.
c.If the shipper does not agree with the findings of certified
inspector at origin, the shipper may request that an inspection at
destination be performed by a certified inspector. If an inspection
results in the shipper owing no additional freight or charges, the
cost of the inspection shall be for the account of the carrier and any
freight due bills, liquidated damages or inspection fees previously
assessed on the shipment will be cancelled or if paid, refunded. If
such an inspection confirms in whole or part the findings of the
certified inspector at origin, the shipper will be responsible for
additional freight due and liquidated damages based on the destination
certified inspector certificate.  In addition, the shipper will also
be required to pay inspection charges incurred at both origin and
destination on the shipment.  If, at shipper's option, the inspection
is performed at consignee's premises and the consignee interferes,
obstructs, or refuses to permit such inspection, the inspection
performed at origin will be considered as true and correct.
 
5.Loading certificate requirement
Where specifically provided for in individual tariff items, a loading
certificate must be completed by the packer of the goods and
surrendered to the carrier prior to the issuance of the Bill of
Lading.
 
6.Consignees affirmative duty
A consignee presenting a bill of lading to the carrier to claim
delivery of cargo shall have an affirmative duty to verify cargo
descriptions on that B/L and to notify the carrier of any discrepancy.
The presentation of a B/L and the taking of delivery of the cargo
constitutes a warranty by the consignee that it has compared the cargo
description on the carrier's B/L with the import declaration and
any other relevant commercial documents available to the consignee
(including but not limited to sales agreements, purchase orders, and
letters of credit)  and that the description of the cargo in those
documents is consistent with the B/L description

OOLL-100 S-6 Misdeclaration of Cargo

A.  Shipper warrants that all documents and other information provided to the Carrier by the Shipper or its agents, which may affect the applicable freight or other charges, are accurate. Carrier, at its discretion, may appoint a sworn measurer to open any container packed by or on behalf of the shipper in order to verify the commodity description, cargo nature, cargo weight, cargo measurement and/or piece count as declared by the shipper to be contained therein and the shipper's compliance with the carrier's tariff rules and rates. Carrier shall have no responsibility or liability for any loss of or damage to the goods or delay in their shipment or delivery arising out of or resulting from such verification, whether or not such information has been correctly stated by the shipper. The container will be re-sealed with the carrier's seal and a notification of such inspection shown on the Bill of Lading or by other notification to the shipper.

The shipper, whose cargo upon inspection by the sworn measurer or local customs is found to have been incorrectly described, weighed, measured, and/or counted, shall be responsible for re-rating of any freight and charges due. Any expense incurred for the inspection shall be for the account of cargo. In addition, an administration fee as shown in below for container with cargo commodity mis-declared, cargo weight either under-declared or over-declared by the shipper by 2 tons or more than the actual cargo weight shall be billed to account of cargo. All additional charges and fees must be paid prior to the release of cargo, irrespective of whether the inspection is performed at origin or at destination.

If the inspection is performed at Consignee's premises and the consignee interferes, obstructs, or refuses to permit such inspection, the Shipper shall be required to pay liquidated damages in lieu of all other charges named herein, based on the greater of:

i. The applicable cargo NOS rate, at the declared weight, measure or piece count; or

ii. US$2,000.00, in addition to all other charges declared by the shipper, but not verified by the Carrier.

 

B.  If the shipper does not agree with the findings of certified inspector at origin, the shipper may request that an inspection at destination be performed by a certified inspector. If an inspection results in the shipper owing no additional freight or charges, the cost of the inspection shall be for the account of the carrier and any freight due bills, liquidated damages or inspection fees previously assessed on the shipment will be cancelled or if paid, refunded. If such an inspection confirms in whole or part the findings of the inspector at origin, the shipper will be responsible for additional freight due, administration fee if applicable and liquidated damages based on the destination certified inspector certificate. In addition, the shipper will also be required to pay inspection charges incurred at both origin and destination on the shipment.

 

C.  To ensure the accuracy of the description and measurements declared by the Shipper, and to ensure that the provisions of this tariff and any service contracts are strictly adhered to, the carrier may request documentation necessary to verify compliance, including but not limited to invoices, customs documentation, freight bills, underlying Bills of Lading, and arrival notices. Said requests shall be made within one year after the shipment date. Shipper or consignee shall provide documentation requested within thirty (30)days of the request. If the request is made prior to the release of cargo to the consignee, the Carrier shall not release the cargo until the documentation is provided. If a misdescription or misdeclaration is found as a result of this inquiry, the cargo interests shall be liable to pay (a) the additional applicable tariff or contract freight and charges due on such cargo as rated correctly, which shall be payable by any party liable for payment of the freight and charges; and (b) an additional amount equal to the full amount of all tariff or contract freight and charges due on the cargo as rated correctly, which shall be paid by the party responsible for the misdescription or misdeclaration. This rerating charge shall be applied separately for each misdescription or misdeclaration on a shipment. For example, if the shipper misdescribes the commodity and also misdeclares the weight or measure of the cargo on the same shipment, the rerating charge would apply twice for that shipment. If documentation is not provided within the thirty (30) days as requested, the Carrier may conclude that a misdescription or misdeclaration has occurred and apply the above additional charges. If a shipment is found to be misdeclared prior to release, the cargo shall not be released to the consignee until the applicable tariff or contract freight and charges referred to in (a) and (b) above, along with any demurrage charges that might be due, have been paid in full.

 

D.  A consignee presenting a Bill of Lading to the carrier to claim delivery of cargo shall have an affirmative duty to verify cargo descriptions on that Bill of Lading and to notify the carrier of any discrepancy. The presentation of a Bill of Lading and the taking of delivery of the cargo constitutes a warranty by the consignee that it has compared the cargo description on the carrier's Bill of Lading with the import declaration and any other relevant commercial documents available to the consignee (including but not limited to sales agreements, purchase orders, and letters of credit) and that the description of the cargo in those documents is consistent with the Bill of Lading description. In the event that (a) the cargo is found to have been misdescribed on the ocean Bill of Lading and (b) the consignee failed to disclose to the carrier the particulars of discrepancy in the cargo descriptions as evidenced by the documentation referred to above, the consignee shall be liable for the rerating charge specified in subparagraph  C of this rule, whether or not the consignee is affiliated with the shipper of the cargo or is acting as delivery or other agent for the shipper. It shall be a defense to liability for the rerating charge if the consignee demonstrates that it reviewed the documentation prior to cargo release and there was no discrepancy between the cargo description in the Bill of Lading on the one hand and, on the other hand, the import declaration and other commercial documents available to the consignee.

 

E.  In the event that misdescription of cargo is found to fall within the following situations, either by means of physical cargo inspection by Carrier; by evidence of other supporting documents or by change of declaration from shipper when cargo is in Carrier's custody:

     i. From general cargo (GC) to hazardous cargo (DG) either in dry or refrigerated stowage, or

     ii. Change of hazardous cargo description such as, but not limited to change of class; UN; packing group; technical name or concentration percentage, or

     iii. Prohibited/Restricted Cargo, or

     iv. Fire Risk Cargo, Lithium Battery, Charcoal, Fish Meal, Seed Cake, Meat and Bone Meal, or

     v. Local Authority confirmed cargo smuggling with cargo misdeclaration.

Shipper shall be liable for the following additional payment prior to the release of cargo:

1. Difference in freight and charges between the actual cargo description and the originally declared description.

2. A liquidated damage of US$30,000 per container shall apply to all cases of cargo misdescription, except for cases falling for hazardous cargo under item (iv) above. For hazardous cargo under item (iv), a liquidated damage of US$50,000 per container shall apply.

3. If physical inspection is performed, all costs associated with physical inspection plus an administrative fee of US$75 per container. Shipper shall further indemnify and hold Carrier harmless from and against all loss, damage, expense, actions and claims for injury to or death of persons and damage to property arising out of such misdescription.



Shipper (any branch office in the same country) mis-declared hazardous cargo for more than once in the same origin country in a calendar year, and/or tendered any mis-declared hazardous shipment causing including but not limited to fire/explosion/leakage/spillage and/or if cargo owner committed a criminal offense as determined by an authority due to mis-declaration of cargo, will be suspended from placing any hazardous cargo bookings with Carrier for at least 3 months. Prior to lifting of such suspension, shipper is required to provide a preventive plan for misdeclaration of hazardous cargo to Carrier for review. Carrier reserves the rights to reject the proposed preventive plan from shipper if the plan is deemed to be inadequate to meet Carrier's requirements.



 F.  When cargo is found to have undergone fumigation without proper aeration and missing warning sign affixed to the container pursuant to IMO requirements, a misdeclaration fee of US$200 per container will be assessed.

SMLM-700 101 1. THE OFFICE OR AGENTS OF THE CARRIER AT CARRIER'S BASE
LOADING PORT WILL ASSESS FREIGHT ON THE SHIPMENTS ON THE
BASIS OF THE GROSS WEIGHTS AND/OR MEASUREMENTS DECLARED OR
DEEMED TO HAVE BEEN DECLARED BY SHIPPERS.  SUCH ASSESSMENT
IS SUBJECT TO THE TERMS AND CONDITIONS OF THE CARRIER'S
BILL OF LADING.  NOTWITHSTANDING THE FOREGOING, CARRIER
MAY ARRANGE AT THE PORT OF DESTINATION FOR THE VERIFICATION
OF THE DESCRIPTION, MEASUREMENT OR WEIGHTS OF ALL SUCH
SHIPMENTS AS THEY, AT THEIR SOLE DISCRETION, MAY DECIDE AND
IN ALL SUCH CASES THE DESCRIPTION, MEASUREMENTS OR WEIGHTS
SO OBTAINED SHALL BE USED FOR DETERMINING THE CORRECT
AMOUNT OF FREIGHT WHICH HAS TO BE PAID AND EXPENSE INCURRED
SHOULD BE FOR ACCOUNT OF CARGO.

2. IF THE GROSS WEIGHTS AND/OR MEASUREMENTS DECLARED BY THE
SHIPPERS ARE LESS THAN THOSE ASCERTAINED BY THE SWORN
MEASURES AND IF THE SHIPPERS BY NOTIFICATION TO THE SWORN
MEASURES OR THE CARRIER WITHIN SEVEN (7) DAYS OF THE
VESSELS SAILING FROM CARRIER'S BASE PORT OF LOADING OR, THE
CONSIGNEE, BY NOTIFICATION TO THE CARRIER PRIOR TO THE
SHIPMENT LEAVING THE CUSTODY OF THE CARRIER, MAINTAIN THAT
THE GROSS WEIGHTS AND/OR MEASUREMENTS STATED BY THEM ARE
CORRECT, FREIGHT SHALL BE ASSESSED PROVISIONALLY ON THE
CONTROLLERS' FIGURES AND SUBSEQUENTLY ADJUSTED, IF
NECESSARY, AFTER AN OUTTURN REWEIGHING AND/OR REMEASURING.
IF SUCH OUTTURN REWEIGHING, REMEASURING AND/OR RESURVEYING
SHOWS THAT THE GROSS WEIGHTS, MEASUREMENTS AND/OR
DESCRIPTION WERE UNDERSTATED AND/OR MISDECLARED BY THE
SHIPPER, REMEASURING AND/OR RESURVEYING SHALL BE FOR THE
ACCOUNT OF THE CARGO.

3. ANY PAYMENT OF ADDITIONAL FREIGHT AND CHARGES ARISING
FROM THE INSPECTION OF CARGO, MUST BE PAID PRIOR TO THE
RELEASE OF THE CARGO, IRRESPECTIVE OF WHETHER THE
INSPECTION IS PERFORMED AT ORIGIN OR AT DESTINATION.

4. PRIOR TO THE DISCHARGE OF CARGO AT THE DESTINATION PORT,
THE SHIPPER OR CONSIGNEE SHALL PROVIDE THE OCEAN CARRIER
COPIES OF THE ACTUAL ENTRY SUMMARY (CUSTOMS FORM 7501 OR
3311) OR OTHER ENTRY DOCUMENTATION (CUSTOMS FORM 3461 OR
7533) SUBMITTED TO THE U.S. CUSTOMS SERVICE WITH RESPECT TO
THE SHIPMENT.  THE CARRIER SHALL NOT BE OBLIGATED TO
RELEASE THE CARGO TO CONSIGNEE UNTIL THE REQUIRED DOCUMENTS
ARE PROVIDED.

THIS PROVISION APPLIES ONLY TO THE FOLLOWING COMMODITIES,
ORIGINS AND DESTINATIONS:

- NOT APPLICABLE TO ANY COMODITIES, ORIGINS OR DESTINATIONS
  AT THIS TIME.

5. TO ENSURE THE ACCURACY OF THE DESCRIPTION AND
MEASUREMENTS DECLARED BY THE SHIPPER, AND TO ENSURE THAT
THE PROVISIONS OF THIS TARIFF AND ANY SERVICE CONTRACTS ARE
STRICTLY ADHERED TO, THE CARRIER MAY REQUEST DOCUMENTATION
NECESSARY TO VERIFY COMPLIANCE, INCLUDING BUT NOT LIMITED
TO INVOICES, CUSTOMS DOCUMENTATION, FREIGHT BILLS,
UNDERLYING BILLS OF LADING, AND ARRIVAL NOTICES.  SAID
REQUESTS SHALL BE MADE WITHIN ONE YEAR AFTER THE SHIPMENT
DATE.  SHIPPER OR CONSIGNEE SHALL PROVIDE DOCUMENTATION
WITHIN THIRTY (30) DAYS OF THE CARRIERS REQUEST. IF THE
REQUEST IS MADE PRIOR TO THE RELEASE OF CARGO TO THE
CONSIGNEE, THE CARRIER SHALL NOT RELEASE THE CARGO UNTIL THE
DOCUMENTATION IS PROVIDED.  IF A MISDESCRIPTION OR
MISDECLARATION IS FOUND AS A RESULT OF THIS INQUIRY, THE
CARGO INTERESTS SHALL BE LIABLE TO PAY (A) THE ADDITIONAL
APPLICABLE TARIFF OR CONTRACT FREIGHT AND CHARGES DUE ON
SUCH CARGO AS RATED CORRECTLY, WHICH SHALL BE PAYABLE BY ANY
PARTY LIABLE FOR PAYMENT OF THE FREIGHT AND CHARGES; AND (B)
AN ADDITIONAL AMOUNT EQUAL TO THE FULL AMOUNT OF ALL TARIFF
OR CONTRACT FREIGHT AND CHARGES DUE ON THE CARGO AS RATED

OR MEASURE OF THE CARGO ON THE SAME SHIPMENT, THE RERATING
CHARGE WOULD APPLY TWICE FOR THAT SHIPMENT.  IF
DOCUMENTATION IS NOT PROVIDED WITHIN THE THIRTY (30) DAYS AS
REQUESTED, THE CARRIER MAY CONCLUDE THAT MISDESCRIPTION OR
MISDECLARATION HAS OCCURRED AND APPLY THE ABOVE ADDITIONAL
CHARGES.  IF A SHIPMENT IS FOUND TO BE MISDECLARED PRIOR TO
RELEASE, THE CARGO SHALL NOT BE RELEASED TO THE CONSIGNEE
UNTIL THE APPLICABLE TARIFF OR CONTRACT FREIGHT AND CHARGES
REFERRED TO IN (A) ABOVE HAVE BEEN PAID IN FULL.

6. A CONSIGNEE PRESENTING A BILL OF LADING TO THE CARRIER TO
CLAIM DELIVERY OF CARGO SHALL HAVE AN AFFIRMATIVE DUTY TO
VERIFY CARGO DESCRIPTIONS ON THAT B/L AND TO NOTIFY THE
CARRIER OF ANY DISCREPANCY.  THE PRESENTATION OF A B/L
AND THE TAKING OF DELIVERY OF THE CARGO CONSTITUTES A
WARRANTY BY THE CONSIGNEE THAT IT HAS COMPARED THE CARGO
DESCRIPTION ON THE CARRIER'S B/L WITH THE IMPORT
DECLARATION AND ANY OTHER RELEVANT COMMERCIAL DOCUMENTS
AVAILABLE TO THE CONSIGNEE (INCLUDING BUT NOT LIMITED TO
SALES AGREEMENTS, PURCHASE ORDERS, AND LETTERS OF CREDIT)
AND THAT THE DESCRIPTION OF THE CARGO IN THOSE DOCUMENTS
IS CONSISTENT WITH THE B/L DESCRIPTION.  IN THE EVENT
THAT (A) THE CARGO IS FOUND TO HAVE BEEN MISDESCRIBED ON
THE OCEAN B/L AND (B) THE CONSIGNEE FAILED TO DISCLOSE TO
THE CARRIER THE PARTICULARS OF DISCREPANCY IN THE CARGO
DESCRIPTIONS AS EVIDENCED BY THE DOCUMENTATION REFERRED
TO ABOVE, THE CONSIGNEE SHALL BE LIABLE FOR THE RERATING
CHARGE SPECIFIED IN SUBPARAGRAPH F OF THIS RULE, WHETHER
OR NOT THE CONSIGNEE IS AFFILIATED WITH THE SHIPPER OF
THE CARGO OR IS ACTING AS DELIVERY OR OTHER AGENT FOR THE
SHIPPER.  IT SHALL BE A DEFENSE TO LIABILITY FOR THE
RERATING CHARGE IF THE CONSIGNEE DEMONSTRATES THAT IT
REVIEWED THE DOCUMENTATION PRIOR TO CARGO RELEASE AND
THERE WAS NO DISCREPANCY BETWEEN THE CARGO DESCRIPTION IN
THE B/L ON THE ONE HAND AND, ON THE OTHER HAND, THE
IMPORT DECLARATION AND OTHER COMMERCIAL DOCUMENTS

However, please ensure that you strongly remind your booking clients to carefully verify that the declared goods match the actual shipment to avoid unforeseeable costs and risks. It should also be noted that U.S. Customs and Border Protection (CBP) has strict regulations regarding the accuracy of declared goods and has published corresponding penalty provisions. Upon detection, CBP will require the shipping line to collect the fines on its behalf.”

  Charges for Misdeclaration of Dangerous Goods
As part PIL’s efforts to protect our crew, ships and cargo with safe practices, a charge of USD 30,000.00 per bill of lading globally is being imposed upon the shipper and/or consignee for any misdeclaration of dangerous and hazardous cargoes / goods (DG Goods).

Misdeclaration includes but is not limited to incorrect/partial declaration, late declaration, alteration or omission of such declaration.

In addition to this charge, we wish to highlight that amongst others, the shipper and consignee will be held liable and responsible for all corrective measures, claims, fines, liabilities, losses, delays, damages or expenses arising in consequence of such misdeclaration. Please also refer to PIL’s bill of lading Terms and Conditions.

We also wish to highlight that failure to properly declare DG Goods constitutes a breach of contract which also violates the applicable law, endangers lives, causes significant economic losses and adversely affects the operations of the entire supply chain.
